END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (“User,” “you,” or “your”) and PubSpeak AI (“Company,” “we,” “us,” or “our”) governing your use of the PubSpeak AI mobile application and related services (collectively, the “App”).

By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement.

If you do not agree to these terms, do not use the App.

1. License Grant

Subject to your compliance with this Agreement, PubSpeak AI grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device that you own or control, strictly for personal and non-commercial purposes.

This license does not grant you ownership of the App or its content.

2. Restrictions

You agree not to:

- Copy, modify, or distribute the App

- Reverse engineer, decompile, or attempt to extract the source code

- Use the App for illegal or unauthorized purposes

- Circumvent or disable security features of the App

- Use the App in a way that harms the service or other users

3. AI Analysis Disclaimer

PubSpeak AI provides automated analysis of speech, voice patterns, body language, and presentation skills using artificial intelligence technologies.

The results provided by the App are intended for informational and educational purposes only.

We do not guarantee the accuracy, completeness, or reliability of AI-generated feedback.

Users should use their own judgment when applying any recommendations provided by the App.

4. User Content

When using PubSpeak AI, you may record videos, audio, or other content (“User Content”) for analysis.

By using the App, you grant PubSpeak AI a limited license to process this content solely for the purpose of:

- Providing AI analysis

- Improving the App’s functionality

- Delivering feedback and insights

We do not claim ownership of your User Content.

5. Privacy

Your use of the App is also governed by our Privacy Policy.

The Privacy Policy explains:

- What data we collect

- How we process and store your data

- How AI services may process your information

Please review our Privacy Policy carefully.

6. Subscriptions and Payments

PubSpeak AI may offer optional paid subscriptions such as:

- PubSpeak Pro Monthly

- PubSpeak Pro Yearly

Payment will be charged to your Apple ID account at confirmation of purchase.

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.

Your account will be charged for renewal within 24 hours before the end of the current period.

You can manage or cancel subscriptions in your Apple Account Settings.

All payments are handled by Apple in accordance with the App Store terms and conditions.

7. Termination

This Agreement is effective until terminated.

Your rights under this Agreement will automatically terminate if you fail to comply with its terms.

Upon termination, you must stop using the App and delete all copies of it.

8. Disclaimer of Warranties

The App is provided “as is” and “as available.”

To the maximum extent permitted by law, PubSpeak AI disclaims all warranties, whether express or implied, including but not limited to:

- Merchantability

- Fitness for a particular purpose

- Non-infringement

We do not guarantee that the App will be uninterrupted, error-free, or completely secure.

9. Limitation of Liability

To the maximum extent permitted by law, PubSpeak AI shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

This includes, but is not limited to:

- Loss of data

- Loss of profits

- Loss of opportunities

- Personal or professional outcomes resulting from speech training

10. Changes to This Agreement

We may update this Agreement from time to time.

When we do, we will update the “Last Updated” date above.

Continued use of the App after changes means you accept the revised Agreement.

11. Governing Law

This Agreement shall be governed by and interpreted in accordance with applicable laws, without regard to conflict of law principles.
